Legal notice
Last reviewed: 4 Oct 2026 · Version 2.0
Purpose
The purpose of this Legal notice (the “CONDITIONS”) is to regulate access to and general use of the porsitoca.es portal (the “WEBSITE”), as well as the different content and services provided by the Holder or by third parties from and/or through it.
1. Ownership and definitions
1.1. This Website is run by Vitalie Ciobanu (the “HOLDER”), with NIE Y3939529B, registered address in Tarragona, El Vendrell.
To contact the HOLDER, you can call +34.633.10.70.42 or, if you prefer, write to vitalie@porsitoca.es.
1.2. For the purposes of these Conditions, the term “Holder” or “We” refers to the Holder of the Website, identified in the previous section. The term “You” or “User” refers to anyone who accesses, browses or in any way uses the Website and its content.
1.3. The date from which the Conditions apply is the one shown at the top of this document.
2. Use of the website
Through the Website, the Holder provides access to and use of its content, made available to the User directly by the Holder or by third parties.
2.1. Use of the Website makes You a User, which implies full and unreserved knowledge of and adherence to these Conditions. The Holder reserves the right to modify these Conditions, or any other content binding on the User, without prior notice, so you are advised to review them each time you visit the Website.
2.2. The User undertakes to use the Website and the content offered on it in accordance with these Conditions and any other notices, rules of use or instructions made known to them, diligently and correctly, and undertakes not to use it:
• To carry out activities contrary to the law, to morality, to generally accepted good custom and to the requirements of good faith.
• For unlawful purposes or effects, prohibited by these conditions or harmful to the rights or interests of the Holder or third parties, infringing intellectual and industrial property regulations or any other rule of the applicable legal system.
• To carry out any action that could disable, overload or damage systems, equipment, servers or services of the Website, or accessible directly or indirectly through it.
• To reproduce, copy, distribute, make available or otherwise publicly communicate, transform or modify the Content, unless authorised by the holder of the corresponding rights or legally permitted.
3. Exclusion of warranties and liability
3.1. The Holder does not guarantee the truthfulness, accuracy, completeness or currency of the Content. The Holder excludes, to the fullest extent permitted by law, any liability for damages of any kind that may be due to the lack of truthfulness, accuracy, completeness and/or currency of the content.
3.2. The Holder tries, by every technical means possible, to keep the Website always available, operational and working at its best. However, at times, and given the nature of the digital environment, incidents beyond our control may occur that prevent use of, access to and/or browsing through the Website. Where reasonably possible, the Holder will give prior warning of interruptions in the operation of the Website and the services. Nor does the Holder guarantee the usefulness of the Website and the services for any particular activity, or their infallibility and, in particular, though not exclusively, that Users can actually use the Website or access the different web pages that make up the Website.
The Holder excludes, to the fullest extent permitted by law, any liability for damages of any kind that may be due to lack of availability, failures in access, operation and continuity of the Website, or the frustration of the usefulness that Users may have attributed to the Website, to the reliability of the Website, and in particular, though not exclusively, to failures in access to the different web pages of the Website.
3.3. We may provide access through technical link devices (such as, among others, links, banners, buttons), directories and search tools that allow Users to reach websites belonging to and/or managed by third parties (“third-party sites”) for the sole purpose of making it easier for Users to search for and access the information, content and services available on the Internet.
The Holder does not offer or market, on its own or through third parties, the information and content available on third-party sites, nor does it control them beforehand, approve, recommend, monitor or make them its own, unless expressly stated otherwise.
The Holder neither guarantees nor accepts any liability for the content or information provided or collected by these third-party sites, or for their operation, availability, accessibility or continuity, or for damages that may arise from use of, access to or browsing through them. If you send personal information through any of these third-party sites, your information is governed by their respective privacy policies.
If a User considers that any third-party site, including those in search results, contains unlawful activity or information and wishes to ask for the link to be removed from the Website, they may contact the Holder by email at vitalie@porsitoca.es.
3.4. The Holder has taken all the measures that current technology allows to guarantee and prevent the existence or transmission of viruses and/or any other kind of harmful software through the Website.
The Holder accepts no liability and cannot guarantee the absence of viruses or similar elements on the Website and/or on the server where it is hosted. The Holder excludes, to the fullest extent permitted by law, any liability for damages of any kind that may be due to the presence of viruses or other elements in the content that may cause alterations in the User's computer system, electronic documents or files.
3.5. The Holder may at any time, at its sole discretion and without any obligation of prior notice, permanently remove the Website from the Internet and, therefore, the content offered from or through it. Where reasonably possible, the Holder will give prior warning of the end or suspension of the provision of the Website's service/content. The Holder is exempt from any liability arising from the consequences of the permanent suspension of those services.
4. Industrial and intellectual property rights
4.1. The intellectual and industrial property rights over the content, including texts, corporate marks, trademarks, designs, illustrations, images, guides, source code and any other element of the Website, belong exclusively to the Holder and, where applicable, to the entities or persons expressly indicated, all of them being protected by Spanish law and by the applicable European and international rules.
4.2. The Content and elements of the Website are the intellectual property of the Holder, group companies or third parties, and may not be understood as transferred to the User; the User is expressly forbidden to reproduce, transform, distribute, publicly communicate, make available, extract, reuse, forward or use in any way, by any means or procedure, any of them, except where legally permitted or authorised by the holder of the corresponding rights. Users are expressly forbidden to reproduce, transform, distribute, publicly communicate, make available to the public, extract, reuse, forward or use in any way, by any means or procedure, any of these elements, unless they are legally entitled or authorised by the holder of the corresponding rights.
4.3. The User may view and obtain a temporary private copy of the Content for their exclusive personal, private and non-collective use on their computer systems (software and hardware), provided it is not for the purpose of carrying out collective, commercial or professional activities.
5. Changes to the conditions of use
We reserve the right to modify these conditions, in whole or in part, the new ones agreed applying from the date of their publication on our Website. You should therefore read the Conditions carefully and review them regularly to be familiar with the updated version.
6. Applicable law
Without prejudice to the rights of Users who are consumers under mandatory law, this legal notice and its conditions are governed by Spanish law.
7. Contact
Your contributions and comments are important to improve every day. If you wish to contact us you can do so by email at vitalie@porsitoca.es.
8. What this site is
A private tool to document a lottery ticket penya among people who know each other. Everyone buys their tickets wherever they like, registers them here, and all the members of the penya hold a proportional share of all the registered tickets.
The site does three things: it records which tickets there are and whose they are, it works out the shares and the split of a prize, and it documents that all of this was agreed before the draw.
The Website is run by the Holder as a private individual. There is no company, no firm and no commercial activity behind it: it is a tool made for a penya of friends and family. Entry is by invitation only: there is no open registration, and the site is not a service offered to the public.
The rules of the penya that are accepted with each ticket are not these Conditions: they have their own versions, and each acceptance keeps the exact text that was accepted.
9. What it is not
No lottery is sold here. Selling and brokering are reserved to SELAE and its authorised outlets.
No tickets are bought or held: each ticket is bought and kept by its owner, who is the one who presents it for payment.
No shares or any other securities are issued.
No money moves. The site does not collect contributions, does not hold prizes and has no balance. Money goes from one person to another, by Bizum or bank transfer, outside this site. All the site does is note who owes what to whom.
The penya agreement is a private agreement between people who know each other, and this site only documents it.
If you find a fault, something that does not add up in the accounts, or anything that looks like a security problem, write to vitalie@porsitoca.es before anybody else.
10. Hosting
With Raiola Networks S.L., on servers in Spain. The whole site is served over HTTPS.
